Customers Terms and Conditions of Sale
- In these Terms & Conditions of Sale, ‘Variety’, ‘The Company’ or ‘we/our’ means Variety Christmas Savings Club Ltd; and ‘Customer’ or ‘Agent’ means any person ordering for themselves, or on behalf of their named customer(s). Variety reserves the right to request from, or to obtain electronically, proof of identification, including age, as Variety may require in respect of any Customers order.
- By submitting an order, you are appointing your Agent to act on your behalf to collect and be responsible for your payments, and to receive and be responsible for your gift cards (when fully paid) until distributed to you. In all dealings you will remain the customer of your Agent unless you notify Variety of your decision not to be so.
- Variety do not employ, appoint, or nominate any Agent. All Agents are appointed by their own customers to act on their behalf. The Agent is not authorised to act on behalf of Variety. Therefore, Variety cannot be held responsible for any actions, omissions or conduct of the Agent, unless authorised in writing by Variety.
- On receipt of a Customer’s order Variety will print a Savings Club Card, giving details of the order and the savings terms selected. Your Agent will give their Customer this card, and it is the Customer’s interest to retain this card and ensure your Agent signs the card as receipt of all the payments given.
- Regular payments are requested, either weekly or monthly. All orders must be settled by the 1st of November. Payments can be made by Cash, Cheque or Debit Card.
- Variety can only be held responsible for safeguarding Customers’ savings once they have been received by Variety. Therefore, any payments not received by Variety remain the responsibility of the Customer and/or Agent.
- Savings placed with a UK bank, authorised and regulated by the Financial Services Authority, are protected by the Financial Services Compensation Scheme (FSCS). Should the bank that Variety places your savings deposits with fail, you authorise Variety to disclose your personal details (such as your name, address and savings amount) to the FSCS, and for us to receive any sum to which you are entitled from the FSCS and subsequently apply such sum towards the fulfilment of your order.
- Customers have the right to change their order to goods of the same value any time before the 1st of October.
- Variety and your Agent reserve the right to change or cancel all or part of a customers’ order if payments have fallen more than 8 weeks (2 months) in arrears. Customers will be informed directly if this occurs.
- Any dishonoured cheques Variety receives from a Customer will incur a fee of £6 to cover bank charges and administrative expenses.
- If Variety receive notification of a cancellation or reduction of a Customers’ order before the 31st of August, there will be no charge. Thereafter, to cover Administration costs and the risk of stock overage, Variety reserves the right to levy a cancellation fee on all orders cancelled or reduced. Therefore, from 1st of September a fee of 5% of the order amount being cancelled (with a minimum charge of £5) may be applied to a Customer’s account.
- Variety will ensure prompt despatch of all Customers orders to their Agent, after all the total payments due from the Agency have been received by Variety. This usually occurs between 1st of October and 30th of November.
- Variety undertakes to notify your Agent whenever necessary about any changes to retailers listed on the gift cards and vouchers. Should any retailer cease to supply gift cards and vouchers to Variety, Customers have the right to change or cancel their order without charge.
- Any change to a Customer’s name or address must be notified to your Agent who should then notify Variety.
- No cash will be refunded; any refunds will be issued in gift cards or vouchers.
- Customers have the right to contact Variety directly at any time and for whatever reason in full confidentiality. If doing so, Variety will request some personal details of the Customer (name, address, and/or account number) to identify their account.
